Overview of Sleeper Berth Usage
A sleeper berth is a compartment within a truck designed for rest or sleep. The regulations allow truck drivers to use these compartments in various ways to meet required off-duty periods, ensuring they remain rested and alert.
Three Ways to Use Sleeper Berths
1. Full 10-Hour Off-Duty Period
Drivers can use the sleeper berth to fulfill all of their required 10 hours of off-duty time continuously. During this period, they must not perform any on-duty activities. Completing 10 consecutive hours in the sleeper berth allows drivers to reset their driving limits for the next period.
2. Split Sleeper Berth Option
If you integrate at least 7 consecutive hours in the sleeper berth with an additional period of up to 3 hours, either before or after the 7 hours, spent off duty or as a passenger in a moving vehicle, and these periods together amount to at least 10 consecutive hours, this arrangement fulfills the off-duty requirements specified in § 395.3(a)(1).
3. Flexible Sleeper Berth Pairs
You can also utilize two separate off-duty periods under the sleeper berth provision in § 395.1(g). One of these periods must consist of at least 7 consecutive hours in the sleeper berth. This should be combined with another period of at least 2 hours, which can be spent either in the sleeper berth or off duty, provided that the total of both periods is at least 10 hours. When these periods are used in combination, neither counts towards the 14-hour driving window. The order in which these periods are taken does not affect their validity.
Key Principles for Compliance
- The compliance calculation for both the 11-hour driving limit and the 14-hour driving window starts after the completion of the first period in a qualifying sleeper berth pairing.
- Only the combined qualifying rest periods are excluded from the 14-hour driving window.
- All time surrounding the paired rest periods must be considered when calculating compliance with driving limits.
Recalculation and Continuation
Each time a driver completes one of the required rest periods under the sleeper berth rules, they must recalculate their available on-duty and driving hours. The use of sleeper berth regulations allows drivers to manage their hours effectively until they complete a full 10 hours of off-duty time, after which the full driving time and window become available again.

#2 Analysis
Next, we set up a second pair of qualifying rest breaks. This involves a 7-hour sleeper berth period from 1st Day(#2) paired with a 4-hour period on 2nd Day (#3). This second calculation period spans from 10:00 AM on Day 1 to 5:00 AM on 2nd Day. During this timeframe, the 7-hour break (#2) is not counted in the total hours, helping the driver maintain 11 hours of driving time and 12 on-duty hours, thus remaining compliant.
# 3 Analysis
The third calculation period begins at 10:00 PM on 1st Day and concludes at 2:00 PM on 2nd Day, highlighted by the driver taking a 10 consecutive hour rest in the sleeper berth (#4). Throughout this period, the driver logs 10.5 hours of driving and accumulates 12 hours on-duty.
After completing #4, the driver is eligible to reset both the 11-hour driving and the 14-hour on-duty limits. This example effectively demonstrates compliance with the Hours of Service (HOS) regulations, with no breaches occurring throughout the detailed periods.
